Definitions

In these Terms, the following words have the meanings set out below:

Acceptance of Terms

By accessing the Platform or submitting any enquiry, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

Your acceptance occurs when you:

• Browse or use any part of the Platform;
• Submit an enquiry form or rate calculator request;
• Click any "I agree", "Submit", "Find My Rate", or similar button; or
• Otherwise engage with the Service.

About Our Service

RateChaserAI is a lead generation and referral platform. We are not a mortgage broker, credit provider, credit representative, or financial adviser. We do not:

• Arrange, provide, or manage home loans or credit products;
• Act as an agent or representative of any Partner lender or broker;
• Provide credit assistance as defined in the National Consumer Credit Protection Act 2009 (Cth);
• Provide financial product advice as defined in the Corporations Act 2001 (Cth).

Our Service operates by collecting information you provide, matching it against criteria of our Partner network, and sharing your details with one or more Partners who may contact you to discuss home loan options.

Eligibility

To use the Platform and submit an enquiry, you must:

• Be at least 18 years of age;
• Be an Australian resident or citizen, or otherwise eligible to enter into a credit contract in Australia;
• Have the legal capacity to enter into binding agreements;
• Not be accessing the Platform from a jurisdiction where such use is prohibited by law.

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to refuse service to anyone who does not meet these requirements or who we reasonably believe may misuse the Platform.

Use of the Platform

5.1 Permitted Use

You may use the Platform solely for lawful, personal, non-commercial purposes in connection with finding a home loan or refinance option for yourself or an entity you are authorised to represent.

5.2 Prohibited Conduct

You must not use the Platform to:

• Submit false, misleading, or fraudulent information in any enquiry form;
• Submit enquiries on behalf of another person without their knowledge and consent;
• Scrape, crawl, copy, or extract data from the Platform by automated or manual means;
• Reverse-engineer, decompile, or attempt to access the underlying source code of the Platform;
• Interfere with or disrupt the integrity or performance of the Platform or its infrastructure;
• Introduce malware, viruses, or other harmful code;
• Use the Platform for any commercial purpose, including competitor research or data harvesting;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Engage in any conduct that is unlawful, defamatory, threatening, or abusive;
• Violate any applicable law, regulation, or the rights of any third party.

We reserve the right to investigate and take appropriate legal action against any person who violates these prohibitions.

Lead Generation & Referrals

6.1 Consent to Share Information

By submitting an enquiry form, you expressly consent to us sharing your personal information and financial profile with one or more Partners in our network who are matched to your enquiry. You understand and agree that:

• You may be contacted by one or more Partners by phone, email, or SMS;
• You are not obligated to engage with any Partner who contacts you;
• Partners are independent businesses responsible for their own conduct;
• We do not guarantee that any Partner will contact you or that contact will occur within any specific timeframe.

6.2 Accuracy of Information

You must ensure that all information you submit is accurate, complete, and up to date at the time of submission. We rely on the accuracy of your information to match you with appropriate Partners. Submitting false or misleading information may result in inappropriate referrals and may constitute a breach of these Terms.

6.3 No Exclusive Arrangement

Submitting an enquiry does not create an exclusive arrangement between you and any Partner or between you and RateChaserAI. You remain free to seek home loan advice or products from any source at any time.

6.4 Rate Calculator

The rate calculator tool on our Platform is provided for illustrative and indicative purposes only. Calculations are based on the inputs you provide and standardised assumptions. Results do not constitute a quote, offer, or pre-approval from any lender and should not be relied upon as an accurate prediction of repayments, costs, or loan eligibility.

Not Financial Advice

RateChaserAI does not hold an Australian Financial Services Licence (AFSL) or an Australian Credit Licence (ACL). We are not authorised to provide:

• Financial product advice within the meaning of the Corporations Act 2001 (Cth);
• Credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth);
• Legal, tax, or accounting advice of any kind.

Before making any financial decision, including applying for a home loan or refinancing, you should seek independent advice from a licensed mortgage broker, financial adviser, or other qualified professional who can assess your individual circumstances.

No Guarantee of Outcomes

We do not guarantee that:

• You will be contacted by any Partner following submission of an enquiry;
• Any Partner will approve your loan application or offer you a loan;
• The rates displayed or matched represent the lowest available rates in the market;
• Rate information is current, complete, or accurate at the time you view it;
• The Platform will be available, uninterrupted, error-free, or secure at all times.

Interest rates, loan products, and lending criteria change frequently. All rate information published on our Platform is indicative only and may not reflect current market conditions or your individual eligibility.

Partner Conduct

All Partners in our network are required to hold the appropriate ACL and comply with applicable laws, including the National Consumer Credit Protection Act 2009 (Cth) and the Australian Securities and Investments Commission Act 2001 (Cth).

However, Partners are independent third parties. RateChaserAI is not responsible for:

• Any advice, recommendations, or representations made by a Partner;
• The terms, fees, or conditions of any loan product offered by a Partner;
• Any act, omission, or misconduct of a Partner;
• Any loss or damage arising from your dealings with a Partner.

If you have a complaint about a Partner, you should contact them directly. If unresolved, you may escalate to the relevant External Dispute Resolution (EDR) scheme, such as the Australian Financial Complaints Authority (AFCA) at www.afca.org.au.

User Obligations

When using the Platform, you agree to:

• Provide accurate, truthful, and complete information in all enquiry forms;
• Promptly notify us if any information you have provided changes materially;
• Use the Platform only for its intended purpose of finding home loan options;
• Comply with all applicable laws and regulations;
• Respect the intellectual property rights of RateChaserAI and third parties;
• Not engage in any of the prohibited conduct described in Section 5.

Intellectual Property

11.1 Our IP

All Content on the Platform, including the RateChaserAI name, logo, brand elements, text, graphics, software, tools, rate calculator, and the Platform's design and structure, is owned by or licensed to Fairywren AI Pty Ltd and is protected by Australian and international intellectual property laws.

11.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. This licence does not permit you to:

• Copy, reproduce, distribute, or publicly display any Content;
• Modify, adapt, or create derivative works from any Content;
• Use the RateChaserAI name or logo without our prior written consent;
• Sub-license any rights to any third party.

11.3 Feedback

If you provide us with any feedback, suggestions, or ideas about the Platform, you grant us a perpetual, royalty-free, worldwide licence to use that feedback in any manner without restriction or obligation to you.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in that Policy.

Key privacy points relevant to these Terms:

• By submitting an enquiry, you consent to your personal information being shared with one or more matched Partners;
• Partners will contact you using the details you provide;
• We do not perform hard credit checks;
• You may request access to, or correction of, your information at any time.

Third-Party Links & Content

The Platform may contain links to third-party websites, including the websites of Partners, regulatory bodies, and industry organisations. These links are provided for convenience only. We do not endorse, control, or accept responsibility for the content, privacy practices, or availability of any third-party website.

Your use of any third-party website is subject to that website's own terms and conditions. We recommend that you review the terms and privacy policies of any third-party site you visit.

Disclaimers

To the maximum extent permitted by law, the Platform and all Content are provided "as is" and "as available" without warranty of any kind, express or implied. We specifically disclaim all warranties including, without limitation:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement;
• That the Platform will be uninterrupted, error-free, secure, or free of viruses or harmful components;
• That rate information or calculator outputs are accurate, current, or complete;
• That the Platform will meet your requirements or expectations.

Limitation of Liability

To the maximum extent permitted by law, RateChaserAI and its officers, directors, employees, contractors, and agents will not be liable for any:

• Indirect, incidental, special, consequential, or punitive loss or damage;
• Loss of profit, revenue, savings, data, goodwill, or business opportunity;
• Loss or damage arising from your reliance on rate information, calculator outputs, or any Content on the Platform;
• Loss or damage arising from your dealings with any Partner;
• Loss or damage caused by unauthorised access to your information or any security breach;
• Any act or omission of any third party, including Partners.

Where our liability cannot be excluded, our total aggregate liability to you for any claims arising from or related to these Terms or your use of the Platform is limited to AU$100, or the amount you paid us in the 12 months preceding the relevant event (whichever is greater).

These limitations apply regardless of the legal basis of the claim (including contract, tort, negligence, or statute) and even if we have been advised of the possibility of such loss or damage.

Indemnification

You agree to indemnify, defend, and hold harmless Fairywren AI Pty Ltd and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Platform;
• Your breach of these Terms;
• Any information you submit, including false or misleading information;
• Your violation of any law or the rights of any third party.

Termination & Suspension

We may, at our sole discretion and without notice, suspend or terminate your access to the Platform at any time if we believe you have breached these Terms, engaged in prohibited conduct, provided false information, or for any other reason we consider appropriate.

Termination does not affect:

• Any enquiry leads already submitted to Partners prior to termination;
• Our right to retain your information as required by law or our Privacy Policy;
• Any accrued rights or remedies of either party.

Clauses that by their nature should survive termination — including Sections 7, 11, 14, 15, 16, and 18 — will remain in full force.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law principles.

Any dispute arising from or in connection with these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Western Australia.

Before commencing formal proceedings, you agree to first notify us of the dispute in writing at info@ratechaserai.com and allow 30 days for us to attempt to resolve the matter informally. This does not prevent either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

Changes to These Terms

We may update or revise these Terms at any time. When we do, we will:

• Update the "Last updated" date at the top of this page;
• Post a notice on the Platform; and/or
• Notify you by email where the changes are material and we hold your email address.

Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
